BTW Communications Pty Ltd “Online Web Shop” Terms and Conditions of Sale

In these Terms and Conditions of sale “BTW”, “we” and “us” mean BTW Communications Pty Ltd (ABN 32 054 421 304) located at, 6 Production Place Penrith, NSW 2750, and “you” means you our valued consumer.

These Terms and Conditions of sale together with your order placed on our website constitute the entire contract between us and you for the supply of products ordered from our online web shop. The Contract cannot be varied unless we agree to vary it in writing. Previous dealing shall not vary or negate these terms and conditions in any respect.

You must be eighteen (18) years or older to place orders with BTW. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Should BTW suffer any damage or other losses as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with BTW.

This agreement shall be governed by and construed in accordance with the laws in force in the State of New South Wales, Australia, without giving effect to any principles of conflicts of law. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction to the courts of New South Wales.

Placing your online order on our website

Please be aware that BTW will only accept orders on this website for shipping within Australia. Furthermore only a limited number of BTW products are available for sale on our online web shop, these items are clearly indicated.

You may place an order by completing the order form on our BTW Web Site and clicking the “PLACE ORDER” button.

By placing an order, you make an offer to us to purchase the products you have selected based on these Terms and Conditions.  We will notify you that your order is being processed by sending you an order confirmation and order number via email. We do not formally accept your offer until your order has passed our internal validation procedures. We reserve the right to cancel your orders at our sole discretion.

We will confirm acceptance of your order when we send your Tax Invoice by email confirming shipment of the goods you have ordered. If we cannot process or accept your order after payment is received we will contact you by email or telephone.

You may not alter, change delivery address, or cancel an order without our prior written consent. Any approved order alteration and cancellations may be subjected to a service/restocking fee of up to 15% of the purchase price. Orders cannot be altered or cancelled once goods have been despatched from our warehouse.

Prices shipping costs and GST 

  • All prices displayed on our website are in Australian Dollars and are inclusive of GST.
  • We reserve the right to change the prices for products or remove them from sale at any time.
  • Prices shown for products exclude shipping costs. The shipping costs are calculated and shown separately during the checkout process. The calculation of shipping costs is based on how many and what items you place in your shopping cart.

BTW uses the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using the eWAY gateway are secured payments.

  • Payments are fully automated with an immediate response.
  • Your complete credit card number cannot be viewed by BTW or any outside party.
  • All transactions are performed under 128 Bit SSL Certificate.
  • All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.
  • eWAY is an authorised third party processor for all the major Australian banks.
  • eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by BTW.

BTW will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by you if your credit card is fraudulently used or is used in an unauthorised manner.

Tax Invoice for your order

When your order has been accepted by us and dispatched, we will email you a Tax Invoice to confirm shipment of your order and supply the package tracking number. Please keep your Tax Invoice in a safe place as this document proves the commencement of your warranty period. If your purchase requires warranty service within the warranty period, you will be asked to produce the Tax Invoice when returning the product under warranty for repair.

In order to use the BTW website, we may require information from you in order to provide the best service possible. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including Email. Any information collected by BTW is collected via correspondence from you or your company. This may be via the telephone, Email, mail, fax or directly through our website.

Use of Collection Information

Any details collected from BTW customers is required in order to provide you with our products and/or services, and a high level of customer service. Correspondence is recorded in order to provide service references, and to assist in our staff development.

Storage of Collected Information

The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

BTW uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at sales@btw.com.au. You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of BTW. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.  BTW reserves the right to change these Terms and Conditions of sale at any time. No BTW employee or agent has the authority to vary any of the Terms and Conditions governing any sale.

Force Majeure

BTW shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of BTW, and BTW shall be entitled to a reasonable extension of time for the performance of such obligations.
